Thank you for your interest in our HackGames (“the Games”).  We are so pleased to be delivering this event. By ‘We’ we mean Milk It Academy Pty Ltd (ABN 77 143 106 898) of Level Suite 1/24 Leake Street Essendon VIC 3040.   
 
Our official details are Milk It Academy Pty Ltd (ACN 143 106 898) of Suite 1/24 Leake Street Essendon VIC 3040, trading as MI Academy. We prefer to keep things light and so in this Agreement, we will be referred to as “We”, “Us”, “Our”, and “MI Academy”.   

Please read this document carefully because by submitting your player application, you are agreeing to these terms and conditions.  

 
Event information   

If your player application is successful, it is expected that you participate in two key events throughout the course of the Games:  

  • Day 1 – 28th of February, 2022 - 10 am - 12 pm AEDT (all virtual)  

  • Day 2 – 3rd of March, 2022 - 9:30 am – 4:30 pm (virtual OR in Melbourne’s CBD) 

 
You will be given the opportunity to confirm your availability ahead of player confirmation. We reserve the right to reschedule the Games with timely notice.   
 

How does player selection work? 

We will use the information provided in your application to select our final player line-up and form our teams for the Games. Successful players will be notified via a phone call or email in early February 2022.   
 
Please note that submitting your player application will not guarantee your selection for this event.  

 
 
What happens if you cannot attend?


If your application is successful, you will receive a physical 'HackPack' in the post or on the day of the event. As this event's numbers are strictly limited, it is vital that you notify MI Academy at your earliest opportunity to avoid disruption to the physical or virtual event. 
 

In saying this, we understand that sometimes life gets busy and personal events may mean you cannot attend the Games. If this is the case, we ask that transfer your player ticket by:  

  • Finding a suitable replacement within your organisation  

  • Or, asking MI Academy to select a new player from the shortlist  

 
All ticket transfers must be approved by MI Academy by emailing your request to hello@miacademy.com.au prior to the 14th of February, 2022.  
 
 

Privacy Policy  

When You register for the Games, we will be asking for your personal information. We need this so we know who we are talking to, ensure we add you into the right teamsand can contact you if we need to. You agree that we will handle all personal information we receive from You in accordance with our privacy policy.   
 

 

Cancellation  

As we are all currently aware, sometimes events are cancelled, changed, or postponed due to factors outside of the organiser’s control.  If the Games are cancelled or postponed by us, your successful application will entitle you to attend the rescheduled event.  If you are unable to attend the rescheduled event you can transfer your ticket as stated above.   
 
If the circumstances don’t allow us to go forward with a physical event, our intention is to host the HackGames virtually. In the rare case that we have to cancel however, we will notify you as soon as possible.  
 
 

Inclusions / Exclusions  

Your ticket entitles you to participate in the Games, through electronic or physical means. The specific inclusions of the event are described on the landing page.  

 

Guarantees  

The Games are designed to provide a high-energy environment to work alongside top retailers to solve everyday marketing, sales, and customer experience challenges. Ultimately your level of participation and your experience with the Games are outside of our control.  For this reason, we do not provide any guarantees that attendance at and participation in the Games will produce a particular result for You.  
 
 

Non-Disclosure & Confidential Agreement  

The Games are all about sharing ideas and experiences, so we need to make sure that information is shared in a safe environment.    

In this clause “Confidential Information” means all trade secrets, ideas, know-how, concepts, information in relation to a business and its affairs, sales, marketing or promotional information that is not in the public domain and is disclosed by a participant during the Games.  

Also, in this clause “Discloser” means a person who discloses Confidential Information, and the person’s employer or company that they are an officer of.  

You acknowledge that You may be given access to Confidential Information for the purpose of participating in the Games.    

You agree that You will keep all Confidential Information confidential.  You agree not to:  

  • disclose any Confidential Information to any other person outside of the Games; or  

  • use any Confidential Information other than for the sole purpose of participating in the Games.  

If You are unsure about whether the information is Confidential Information, you must treat the information as if it is Confidential Information.   

 

You acknowledge and accept that:  

  1. financial and other loss and damage may be suffered by the Discloser of Confidential Information if you disclose the Confidential Information or use the Confidential Information for any other purpose than your participation in the Games; and  

  1. that monetary damages would be an insufficient remedy; and  

  1. in addition to any other remedy available, the Discloser is entitled to injunctive relief to prevent a breach of this clause and to compel You to comply with this clause; and  

  1. You will immediately reimburse the Discloser for all costs and expenses (including legal costs and disbursements on a full indemnity basis) incurred by the Discloser and MI Academy in enforcing your obligations under this clause.  

You agree to indemnify the Discloser against all costs, expenses, actions or claim directly or indirectly incurred or suffered by the Discloser as a result of any breach of this clause by You.  

This clause will survive the termination or expiry of this Contract. 
 

Intellectual Property Rights  
For the purpose of this clause, IP is defined by:  

New IP means anything developed or created on the day of the event  

(a) You agree that MI Academy owns any [New IP] that is developed in relation to this Agreement.   

(b) You agree that should you seek to commercialise any New IP, the Parties will enter good faith discussions to determine partnership opportunities of any such commercialisation.   

Any documentation or intellectual property we provide to you during the Games is owned by us and there is no transfer to you.  
 
This clause will survive the termination or expiry of this Contract. 
 

Branding Use  

We would love to identify and promote the organisations involved in the Games.  This means we need consent to use your employers or company logo and by agreeing to these terms and conditions you will be giving us consent under the clause. 

You agree that we can use your employer’s or company’s logo and/or branding for the sole purpose of promoting your attendance at the Games.  We 100% acknowledge that the logo and/or branding belongs to your employer or company and we acknowledge that we have no right title or interest in or to the logo or branding.  

 
 

Image Use  

We may record and take Photographs during the Games.  You grant permission to Us to take and have full and free use of video/photographs containing your image/likeness.  We will only use these images for promotional purposes. You agree that you are not entitled to remuneration, royalties or any form of payment in respect of your image/likeness or its use.  You release, discharge, and hold harmless MI Academyand its agents from any and all claims, demands or causes of actions that they have by reason of anything contained in the photograph or video.  If You do not agree to this image release then please contact us.  
 
 

Behaviour  

The Games will attract individuals that may have different opinions or values to you.  Once again, we want everyone to experience the Games in a safe space.  You must not engage in any conduct that is unlawful, intimidating, threatening, disrespectful, abusive, harmful or that is invasive of the privacy of another.  We reserve the right to expel You from the Games if we reasonably consider Your behaviour is inappropriate.    

You agree to indemnify and hold MI Academy harmless to the extent permitted by law in respect of any claim or action arising from any third party in connection with your behaviour at the Games.  
 


Limitation of Liability  

To the maximum extent permitted by law, we will have no liability for any loss you’ll incur due to your participation in the Games.  

To the extent permitted by law all conditions and warranties relating to your participation in the Games are excluded.    
 
Except for claims arising out of gross negligence or willful misconduct, in no event will the total collective liability exceed $100 AUD.  

For virtual participation, you agree that we cannot be held liable for any software or electronics used throughout the course of the Games.  

 
COVID-Safe Policy  
 

As a participant in the Games, you agree that should you attend the physical event in Melbourne, you will be expected to comply with the State of Victoria’s COVID-safe event guidelines.  
 
 
General  

These terms and conditions form the entire agreement between MI Academy and registered participants at the Games This agreement should be construed in accordance with the laws of Victoria, Australia.  If any clause of these terms and conditions are deemed void or unenforceable then they will be removed from the agreement to the extent of the invalidity and the rest of the clauses will remain.
